Police officer pleads not guilty for murder of 28 year old man

A police officer at Kisii central police station has pleaded not guilty to murder charges before high court Judge Antony Ndung’u.
On a plea conducted online,Bonface Maubi was presented before court and charged with murder contrary to the penal code .
Maubi, a police constable pleaded not guilty to the charges that lead to the death of a 28 year old businessman Bramuel Chikunza.
The accused police officer was arrested for an assault that occurred at kisii police station which led to the death of Bramuel Chikuza while receiving treatment at Nyanchwa mission hospital within kisii.
Advocates; Wilkins Onchoki,Ombui Ratemo,Shaffin Ocharo,kaba,Brenda Nyaega Moguche violet and Omao Kerubo were watching briefs on behalf of the law society of Kenya.
The prosecution side led by Edwin Otieno appointed Stephen Kimaiyo ,an advocate to represent the accused person. However, the accused person appointed Mr Nyamweya to represent him leading to Mr Kimaiyo’s withdrawal from the case.
The accused person was not released on bond as the law society objected to him being released on bond for fear of the witness whereabouts.
However the matter was slated for 8/01/2021 to address the issue of objection of the bond.
The police officer had earlier appeared in court before the court registrar Dorcas Macadere who ordered the the accused to undergo a mental assessment test before facing charges .
Today,Chukunza’s body will be moved from the kisii teaching and referral hospital to his rural home in western for the burial ceremony tomorrow.
Chikunza was arrested together with his colleague Wycliffe Omondi on the night of 19th December last year and was placed under police custody, Chikunza accompanied Omondi to the station to bail out his wife after she was arrested for staying past curfew hours.
In the police cells they were assaulted by a police officer and this led to the death of Chikunza while undergoing treatment at Nyanchwa mission hospital after they were released the following day.
Detectives from the Internal Affairs Unit Headquarters opened an investigation file and submitted the same to the ODPP Kisii who upon perusal directed the police officer from Kisii Central police station, be arrested and charged with the offence of Murder.
