CJ Koome releases Presidential election petition timelines

The Judiciary has released timelines for filing a presidential petition ahead of the elections set for Tuesday, August 9, 2022.

In a notice, Chief Justice Martha Koome said the timelines are to serve as a guide to any party that would want to challenge the results of the presidential election.

“Article 140 (2) of the Constitution, provides a timeframe within which Presidential Election petitions filed in the Supreme Court may be heard and determined. This is a non-negotiable timeframe,” CJ Koome said.

According to the schedule released by the court, an aggrieved party is required to file their petition within seven days after the results are announced by the Independent Electoral and Boundaries Commission (IEBC).

The petitioner will have 24 hours to serve the respondent with suit papers from the time of filing the petition.

The respondents will have four days to respond to the petition from the day of being served. The petitioner will then have 24 hours to serve their rejoinder to the petition.

Parties will have 24 hours to file and serve interlocutory applications. Respondents will be required to file their responses within 24 hours.

Thereafter, third parties (friends of the court) will have a day (24 hours) to file their applications and serve the parties.

Thereafter, a pretrial conference will begin and last for 8 days after which the hearing of the petition will commence immediately.

The Supreme Court will then deliver its ruling within 14 days, from the date the petition is filed.

Azimio – One Kenya coalition candidate William Ruto will face off with Kenya Kwanza’s William Ruto in the hotly contested presidential race.

Others in the race are George Wajackoyah of the Roots party and David Mwaure Waihiga of Agano party.
